Terms of use

The rules for using SPECT, written to be read. Your content stays yours.

1.The agreement

By using SPECT you agree to these terms.

These terms are an agreement between you and Stanley Park Creative Inc. (“we”, “us”) for the use of SPECT: this website, the web app and the SPECT apps for iPhone, iPad and Android. By creating an account or using SPECT you agree to them, and to our privacy policy. If you use SPECT for an organization, you confirm you may accept these terms on its behalf.

2.Your account

Keep your details accurate and your password to yourself.

  • You must be at least 13 years old and able to form a binding agreement where you live.
  • Give accurate information and verify your email address. One account is for one person.
  • Keep your password secure. You are responsible for what happens under your account.
  • An account can be signed in on one device at a time; signing in elsewhere signs the other device out.

3.Your content

What you make is yours. You let us host and show it to the people you share it with.

You keep all rights to the SPECTs and media you create. You give us a limited, worldwide licence to host, store, copy, process and display that content only as needed to run SPECT for you, including showing it to the people you share it with.

You are responsible for your content and must have the rights to everything you upload. Don't upload content that is unlawful, infringes anyone's rights, or that you aren't allowed to share.

4.Sharing and learners

Invite only people you're allowed to contact, and tell learners their answers are visible to you.

When you invite people, you confirm you have the right to send them an invitation. Owners and admins of a workspace can see learners' progress and answers, including written answers. If you invite learners, you are responsible for telling them that, and for any obligations you have to them, for example as their employer or teacher.

5.Acceptable use

Use SPECT fairly and lawfully.

Don't use SPECT to:

  • break the law, or harm, harass or deceive anyone;
  • send spam or unwanted invitations, or misuse our email features;
  • upload malware, or try to get into accounts or systems you aren't allowed to access;
  • copy, scrape, resell or reverse engineer SPECT, or get around its limits or security;
  • overload the service or interfere with other people's use of it.

We may remove content or suspend accounts that break these rules or put others at risk.

6.Plans and payment

Free to start. Paid plans renew monthly until you cancel.

  • The Free plan costs nothing. Each plan has limits, such as the number of users and amount of video.
  • Paid plans are bought in the SPECT web app, billed monthly in US dollars through Stripe, and renew automatically until you cancel. Prices don't include taxes, which may be added.
  • You can cancel at any time in the web app under Plans & billing, Manage billing. Payments are not refundable except where the law requires.
  • If you go over a plan limit, some features (such as inviting people or streaming video) may pause until you upgrade or are back under the limit.
  • We may change prices or plans with at least 30 days' notice for paid subscriptions.

7.Other services

Some parts of SPECT rely on other companies.

SPECT uses services from other providers, such as payments by Stripe and optional email import using Google Gemini. Those services may have their own terms. Links that authors add to their SPECTs lead to sites we don't control, and we aren't responsible for them.

8.Apps from the App Store and Google Play

If you got SPECT from an app store, these extra terms apply.

If you download SPECT from Apple's App Store, you acknowledge that these terms are between you and us only, not Apple, and that we, not Apple, are responsible for the app and its content. Your licence to use the app is limited to Apple-branded devices you own or control, as permitted by the App Store's usage rules. Apple has no obligation to provide maintenance or support. If the app fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price, if any; to the maximum extent permitted by law, Apple has no other warranty obligation. Apple is not responsible for any claims relating to the app, including product liability, legal or regulatory claims, consumer protection claims, or claims that the app infringes someone's intellectual property; we are. You confirm that you are not located in a country subject to a U.S. Government embargo or listed on any U.S. Government list of prohibited or restricted parties. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.

If you download SPECT from Google Play, Google Play's terms also apply to your use of the store.

9.Ending the agreement

You can leave anytime. We can suspend accounts that break these terms.

You can stop using SPECT and delete your account at any time from the app; see how account deletion works. We may suspend or end your access if you seriously or repeatedly break these terms, or if we have to for legal reasons. If we ever stop offering SPECT, we will give reasonable notice so you can save your work.

10.Disclaimers

We work hard on SPECT, but it comes without guarantees.

SPECT is provided “as is” and “as available”. To the extent the law allows, we make no warranties, express or implied, including that SPECT will be uninterrupted or error-free, or fit for a particular purpose. Nothing in these terms limits rights you have under consumer protection laws that cannot be waived.

11.Limitation of liability

Our liability is limited to what you paid us in the last 12 months.

To the extent the law allows, we are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue or data. Our total liability for any claim relating to SPECT is limited to the amount you paid us for SPECT in the 12 months before the claim, or US$100 if you paid nothing.

12.Indemnity

If your content or conduct gets us into trouble, you cover it.

You agree to defend and indemnify us against claims arising from your content, your use of SPECT in breach of these terms, or your violation of anyone's rights, to the extent the law allows.

13.Changes to these terms

We'll tell you about important changes in advance.

We may update these terms. We'll post the new version here with a new date, and give notice of significant changes by email or in the app. If you keep using SPECT after a change takes effect, the new terms apply.

14.Governing law

British Columbia law applies.

These terms are governed by the laws of the Province of British Columbia and the federal laws of Canada that apply there, without regard to conflict-of-law rules. Courts in British Columbia have jurisdiction, unless the law where you live gives you the right to bring a claim in your local courts.
